1. Heard learned counsel for the petitioners, learned A.P.P. for the State and the learned counsel appearing on behalf of the Mines Department.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 303(2), 317(2), 111(2) of the B.N.S.S.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent. It is next submitted that similarly situated co-accused had approached this court seeking anticipatory bail by filing Cr. Misc. No.29831/2025 (Mantu Kumar Raut & Others Vs. The State of Bihar). The said Cr. Misc. No.29831/2025 was heard analogous
Patna High Court CR. MISC. No.35262 of 2025(3) dt.19-08-2025 2/3 with Cr. Misc. No.27682/2025 (Rahul Raj & Others Vs. The State of Bihar and Another). It is submitted that both the aforesaid criminal miscellaneous applications were allowed by a learned coordinate Bench by an order dated 05.08.2025. It is next submitted that case of the petitioners is also on similar footing, thus seeks anticipatory bail, based on parity.

Learned A.P.P. and the learned counsel appearing on behalf of the Mines Department opposes the prayer for anticipatory bail of the petitioners but then are not in a position to rebut the submission of the learned counsel appearing on behalf of the petitioners that similarly situated co-accused have been granted the privilege of anticipatory bail by a learned coordinate Bench.
5. Considering the submissions made by the learned counsel for the petitioners and also taking into consideration the order dated 05.08.2025 in Cr. Misc. No.29831/2025, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned trial court where the case is pending/successor court in
Patna High Court CR. MISC. No.35262 of 2025(3) dt.19-08-2025 3/3 connection with Rajauli P.S. Case No.595/2024, subject to the conditions as laid down under Section 482(2) of the B.N.S.S. (Satyavrat Verma, J) amit/- U T
