Petitioner seeks bail in a case registered under section 392 of the Indian Penal Code.

Prosecution case is that while the informant on 09.04.2014 at about 8 P.M. was going to Rupnarayanpur by his Scorpio BR06PA-9998 and when he reached near Lallu Chhapra Hotel, a bolero overtake and blocked his way, and three criminals came out of the bolero and took the Scorpio in their possession on the point of pistol. It has further been alleged that they snatched his mobile of two sums, a gold chain and Rs. 3000/- cash from his possession.

On behalf of the petitioner it has been submitted

Patna High Court Cr.Misc. No.22128 of 2015 (2) dt.16-07-2015 2/2 that petitioner is in custody since 14.04.2014 and charge sheet has been submitted in the case. It is further submitted that petitioner is not named in the first information report and no recovery of any article has been made. It is also submitted that petitioner has no criminal antecedent.

On behalf of the State it has been submitted that name of petitioner has come during the course of investigation. Considering the aforesaid facts, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of S.D.J.M, West Muzaffarpur in Paroo P.S. Case No. 90 of 2014.
