JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-12-2023 The present writ petition has been filed seeking the following reliefs:- "1) (i) That by way of this writ application petitioner seeks indulgence of this Hon'ble Court for issuance of appropriate writ/order/direction in the nature of Certiorari commanding the respondents to quash the order

Patna High Court CWJC No.13893 of 2021(2) dt.07-12-2023 2/3 dated 3.12.2009 issued by the Managing Director, Bihar State Land Development Bank (hereinafter called Bank), Patna whereby in conclusion of departmental proceeding the petitioner has been inflicted with punishment of deduction of Rs.77,444/- (Rupees Seventy seven thousand four hundred and forty four) from the amount of Gratuity and Leave encashment of the petitioner.

(ii) Further to quash the appellate order contained in memo no.1808 dated 16.5.2018 issued by the Chairman-cum-Appellate Authority inter State Land Development Bank Ltd. Bihar (Patna)/ Jharkhand, whereby the order passed by the disciplinary authority has been affirmed with minor modification that the payable amount shall be paid to the petitioner as per seniority list.

(iii) Further to issue direction in nature of Mandamus directing the respondents to make payment of retiral dues/benefits with up to date admissible rate of interest."

At the outset, the learned counsel for the petitioner seeks not to press the present writ petition, however, seeks liberty on behalf of the petitioner to avail such other alternative remedies as are otherwise available under the law, for redressal of the aforesaid grievances. Liberty, so sought, is granted.

The writ petition stands dismissed as not pressed.
