JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is languishing in custody since 08.11.2014 in connection with Kudra P.S. Case No. 210 of 2014 for the offences instituted under Sections 25(1-B), A and 26 of the Arms Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that on receipt of the information that Chunmun Yadav having a single barrel unauthorized gun has committed offence on N.H. 30 along with his associate, the informant raided the house of Chunmun Yadav and arrested him. On being asked, he confessed that he had kept the gun in the heap of ash subsequently thereafter police made search and found out a single barrel gun of 12 bore and four live
Patna High Court Cr.Misc. No.25340 of 2015 (2) dt.21-07-2015 2/2 cartridges from the heap of ash from inside of the house of the petitioner.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 08.11.2014 and the charge sheet has been submitted in the present case. It is further submitted that as per F.I.R., single barrel gun alongwith four live cartridges are alleged to have been recovered from possession of the petitioner. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Kaimur at Bhabua, in connection with Kudra P.S. Case No. 210 of 2014, G.R. No. 2089 of 2014.
