The present writ petition has been filed for issuance of a writ in the nature of following reliefs:- (i) For quashing the order dated 26.11.1996 passed by the Additional Member, Board of Revenue in Ceiling Revision No. 42/94 whereby revision has been rejected. (ii) For setting aside the order dated 14.6.93 passed by the Collector in Revision Appeal No.57/92-93 whereby appeal has been rejected ex-parte.

(iii) For setting aside the order dated 16.6.1992/23.6.92 in Land Ceiling Case No. 41/74-75/168/8283 whereby only 9 units have been given to petitioner and 17.34 acres of land have been declared surplus.

After hearing the parties, this Court is of the opinion that this matter can well be adjudicated by the Bihar Land

Patna High Court CWJC No.1865 of 1997(11) dt.16-12-2021 2/2 Tribunal (hereinafter in short referred to as the 'Tribunal'). In view of proviso to Section 15 of the Bihar Land Tribunal Act, 2009, the Registry is directed to transmit the record of this case to the Tribunal forthwith. However, considering the fact that the case was pending before this court since long, it is expected that the Tribunal will hear and dispose of the case within a period of one year from the date of receipt of record of this case after giving proper notice to all the parties concerned including the petitioners.

In view of the previous order dated 14.05.1997 passed in the present writ petition, the petitioner is at liberty to file separate application for grant of interim relief. With the aforesaid observation and direction, this writ petition is disposed of.
