JUSTICE PARTHA SARTHY ORAL ORDER 21-12-2020 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The instant application for regular bail has been filed by the petitioner in connection with Jandaha P.S. Case No.35 of 2018 registered against unknown under section 392 of the Indian Penal Code to which section 412 of the Indian Penal Code was added subsequently.

As per allegation in the FIR, the informant was working in a brick kiln belonging to one Mintu Kumar. It is stated that on the date of occurrence four accused persons came in a Bolero car, tied up the informant and others, and after confining them in a room took away three tractors and two trailers, a motorcycle belonging to the informant besides other articles as mentioned in the F.I.R.

No.35672 of 2020(2) dt.21-12-2020 2/3 It is submitted by learned counsel for the petitioner that the name of the petitioner transpired in the confessional statement of co-accused Akbar Ali and Amarjeet. Referring to the order of the learned Court below, it is submitted that the details of the contents of the case diary has been stated in the said order. Besides the confessional statement of the aforesaid two accused there is no other material against the petitioner. It is further submitted that co-accused Akbar Ali and Amarjeet Kumar have been enlarged on bail by different orders which have been brought on record as Annexure-2 series to the petition. The petitioner has no criminal antecedent, he is in custody since 21.7.2020 and investigation with respect to him has already concluded.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the grant of bail to the above mentioned two accused, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Jandaha P.S. Case No.35 of 2018 on his furnishing bail bond of Rs. 10,000/ (Rupees Ten Thousand) with
