====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 16-01-2023 Heard learned counsel for the petitioner and counsel for the Union of India. No one appears on behalf of the Central Bank of India.

Counsel for the petitioner submits that on the point of maintainability, he agree that under the Armed Force Tribunal Act, the remedy is available but on the other hand, he submits

Patna High Court CWJC No.13884 of 2021(4) dt.16-01-2023 2/2 that in the present case, he has no grievances left against the Army Officials and his only grievance is left upon the banking authority. He submits that during the pendency of the writ petition, petitioner has received a letter from the Office of the Principal Controller of Defence Accountant(Pension) (respondent no.2) who has directed to the Chief Manager, Central Bank of India to pay the family pension after submission of the certain documents.

In this view of the matter, it is directed to Chief Manager, Central Bank of India that he shall assure the payment of pensionary benefits in the account of the petitioner within 4 weeks. Upon deposit of the alleged document as mentioned in letter dated 28.07.2021, if non-payment of the said amount still continue, the petitioner shall be at liberty to move before the respondent no.2 who shall assure the payment within 4 weeks thereafter.

With this direction, this writ application stands disposed off.
