Learned counsel for the petitioner, after some argument, seeks permission to withdraw this writ application with a liberty to prefer appeal against the impugned order of cancellation of license under Bihar Targeted Public Distribution System (Control) Order, 2016 (for short ' the Control Order, 2016') dated 24.02.2021 passed by the Sub Divisional Officer, Phulparas.

3. It is observed that if the petitioner files an appeal within four weeks from today and seek condonation of delay on the ground inter alia that he he was pursuing his remedy before this Court, the appellate authority shall consider the petitioner's prayer for condonation of delay and, accordingly, decide the appeal on merits within the time frame as prescribed under the Control order,2016.
