JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 9.2.2016. The informant had filed complaint case bearing Complaint Case No.3193© of 2009, which was converted into Barauni P.S.Case No. 97 of 2010.
The accusation against the petitioner is that he along with co-accused Yogi Mukhiya took the deceased but he did not return and, subsequently, the informant received information that the deceased had been killed.
Learned counsel for the petitioner submits that the informant's husband was a dreaded criminal and he was absconding in several cases but in course of investigation, nothing has come against him, which is evident from perusal of the
Patna High Court Cr.Misc. No.15555 of 2016 (2) dt.19-04-2016 2/2 impugned order.
Considering the aforesaid facts and circumstances as well as submissions of the parties, and also keeping in mind that petitioner does not have any criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Begusarai in connection with Barauni P.S.Case No. 97 of 2010.
