2. From the impugned order, it appears that notice under registered cover was sent to the petitioner but the petitioner has refused to accept the same and in the present proceeding, it has been contended by the learned counsel for the petitioner that impugned order has been passed ex-parte.

3. In the opinion of this Court, the impugned order has been rightly been passed by the Court below when the petitioner has refused to accept the notice.

4. If the petitioner has any grievance then he may approach the District Court, Khagaria by way of filing a

Patna High Court CR. REV. No.426 of 2022(7) dt.29-04-2024 2/2 modification petition under Section 127 of the Cr.P.C. for the modification of the order of maintenance passed by the Principal Judge, Family Court, Khagaria.

5. This application is dismissed with the aforesaid observations.
