JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

Petitioners are named in the first information report with accusation that they along with some other accused took the deceased and subsequently, the dead body of the deceased was found lying in a field.

Admittedly, none has seen the actual killing of the deceased and it appears from perusal of the impugned order that in course of investigation, the witnesses supported the statement of

Patna High Court Cr.Misc. No.16689 of 2016 (2) dt.27-04-2016 2/2 informant and, therefore, even if the statement of informant assumed to be true, then also, it is only a case of last seen. Moreover, the investigation against the petitioners has already been completed.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-III, Rosera, Samastipur in connection with Bibhutipur P.S.
