JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-08-2019 This application, for grant of anticipatory bail, arises out of Gogri P.S. Case No. 43/19, disclosing offences under Sections 341, 323, 379, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioners is of assault to the informant and they have taken away the motorcycle of the informant and also threatened for dire consequence, if he files any case. Apart from that it appears that petitioners are accused in two more cases.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and though there is allegation that they took away the motorcycle of the
Patna High Court CR. MISC. No.34351 of 2019(4) dt.19-08-2019 2/2 informant but there is no recovery from house of the petitioners. Learned counsel for the State opposed the prayer for bail and submitted that the petitioners are accused in two more cases.
Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
This application is, accordingly, dismissed.
