The petitioner seeks bail in a case registered for the offence punishable under sections 364-A of the Indian Penal Code.
Petitioner is not named in the first information report. In course of investigation, he was arrested and confessed his guilt disclosing that he had also followed the vehicle in which the victim was being taken by the main accused after kidnapping. Further more, he accepted his guilt disclosing the fact that he was also involved in the conspiracy of kidnapping. Moreover, the petitioner was put on T.I. parade but he was not identified. Petitioner does not have any criminal antecedent and is
Patna High Court Cr.Misc. No.16350 of 2016 (2) dt.22-04-2016 languishing in jail custody since 25.12.2015. However, some of the co-accused with more or less similar allegation have been enlarged on bail by this Court.
Accordingly, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Subordinate Judge III-cumAdditional Chief Judicial Magistrate, Muzaffarpur in connection with Musahri P.S. Case No. 209 of 2015.
