Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Dhoraiya P.S. Case No. 51 of 2022 lodged under Sections 302, 201 and 120 B of the I.P.C.

As per the prosecution case, the marriage of the informant's daughter was solemnized with the brother of the petitioner in the year 2013 but subsequently, allegation of death alleged to be caused by the petitioner and the entire family members were made accused in the F.I.R.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.35710 of 2022(3) dt.16-11-2022 2/3 petitioner is innocent and has committed no offence. Counsel submits that the antecedent of the petitioner is clean. He submits that petitioner is in custody since 28.03.2022. Counsel submits that petitioner is devar and husband of the deceased is already in custody. He only submits one point before this Court that the matrimonial life of the deceased and her husband was good due to the reason that with their happy conjugal life, they have one son and one daughter.

Learned counsel submits that petitioner is devar and he has nothing to do with the family of his brother. He is living separately and he is in no way concerned with the disputes going on between husband and wife.

Learned counsel for the State opposes the prayer for bail.

Learned counsel for the informant vehemently opposes the prayer for the bail and submits that there is an involvement of the present petitioner in the commission of the crime and bail may not granted to him.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to

With this observation, the bail application stands allowed.
