2. The petitioner apprehends his arrest for the offences alleged under Sections 498(A), 354(B) and 384 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act, registered in connection with Complaint Case No. 891/2022.

3. It is a case of matrimonial dispute.

4. To explore the possibility of amicable resolution of the dispute, the matter was referred to the Patna High Court Mediation and Conciliation Centre. Both the parties resolved their disputes and an agreement to this effect arrived at between them is annexed with the Mediator's report dated 17.10.2025.

Patna High Court CR. MISC. No.34718 of 2025(5) dt.02-12-2025 2/3 Condition no.4 of the agreement was that the petitioner shall deposit an amount of Rs.2000/- per month in account no. 33342108070 which is in the name of Rita Devi, O.P.No.2, maintained with the State Bank of India, Baisi Branch, Purnea.

5. The learned counsel for the complainant submits that the petitioner did not deposit even a single pie in her account and he retracted from his word given in the agreement.

6. The learned counsel for the petitioner submits that the petitioner is bound by his word and he shall pay Rs.2000/- per month regularly to his wife (complainant).

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM,Katihar in connection with Complaint Case No. 891/2022, subject to the followings conditions:- (i). The petitioner shall make payment of Rs. 2000/- (Rupees two thousand) per month regularly, as an interim maintenance, to the opposite party no.2.

Patna High Court CR. MISC. No.34718 of 2025(5) dt.02-12-2025 3/3 (ii). At the time of furnishing bail bond, he shall pay the arrears of maintenance amount which commences from 14.10.2025.

(iii) The bail bond of the petitioner shall be cancelled by the court below, if he fails to make the payment of the agreed amount, without any reasonable cause.
