The petitioner is languishing in custody since 02.03.2015 in a case registered for the offences punishable under Sections 25(1-B)a/26/35 of the Arms Act.

The prosecution case is that the police chased on suspicion then miscreants resorted to fire on the police. One chase one Munna Singh and this petitioner were apprehended. From Munna Singh revolver and cartridges were recovered, who disclosed the name of the persons who escaped from the scene after firing.

It is submitted by learned counsel for the petitioner that the accusation of firing on the police is omnibus and

Patna High Court Cr.Misc. No.22242 of 2015 (2) dt.09-07-2015 2/2 general when none received any injury and there is no recovery from the petitioner. The investigation has already concluded. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 48 of 2015.
