JUSTICE ASHUTOSH KUMAR ORAL ORDER 09-02-2021 Heard Mr. Umesh Chandra Verma, learned counsel for the petitioners and learned APP for the State. The petitioners seek bail in anticipation of their arrest in connection with Pahadpur (Malahi) P.S. Case No. 179 of 2020 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act, 2018.

103.64 litres of liquor is said to have been recovered from a place from where the petitioners are said to have ran away. This disclosure has been made by local

The petitioners have clean antecedents.

Considering the nature of accusation and their not being the persons with criminal antecedents, the petitioners, above named, are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned 7th Additional Sessions Judge-cum-Special Judge (Excise), East Champaran, Motihari, in connection with Pahadpur (Malahi) P.S. Case No. 179 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
