JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This is the third attempt on behalf of the petitioner for grant of regular bail in connection with S.Tr. No.425/15 arising out of Agam Kuan P.S. Case No.383 of 2014 for the offences instituted under Sections 399, 402, 420, 467, 468, 471, 489(A), 489 (B), 489 (C), 489(M)/34 of the I.P.C. and Sections 25 (1-B)a, 26 and 35 of the Arms Act. This is the 3rd attempt on behalf of the petitioner for grant of bail.

The prosecution case, in brief, is that on 26.09.2014 at 7.00 A.M. while the informant was on routine mobile duty, he received information that some ante social elements having

Tower in the premises of constructing park were planning for committing crime, upon which he informed his superior police personnel to reach the said place of occurrence. On seeing them 5 - 6 miscreants started fleeing away but on chase they were apprehended by the police party who disclosed their names as Sanjeet Kumar Sharma, Vikash Kumar, Lal Babu Thakur, Abhijay Pandey, Kallu @ Rajan Das and Dhiraj Kumar Chaudhary.

A report submitted by the Senior Superintendent of Police, Patna, has been kept on record and marked as 'X'. As per the report two witnesses have already been examined in the case. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with S.Tr.No.425/15 arising out of AgamKuan P.S. Case No.383 of 2014, pending in the court of learned Additional District Judge-VI, Patna City, Patna. Anyhow, the court below is directed to take all necessary steps to conclude the trial within a period of eight months from the date of receipt/production of a copy of this order.
