JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-05-2019 Petitioners seek bail in anticipation of their arrest in connection with Rajepur P.S. Case No. 103 of 2017 registered for the offences punishable under Sections 363, 366, 506 and 34 of the Indian Penal Code.

Prosecution story is that the petitioners called the daughter-in-law of the informant with intention to marry her with Ramesh Kumar and thereafter she did not return. Submission of learned counsel for the petitioners is that there was love affair between Ramesh Kumar and the victim girl and petitioners are relatives of said Ramesh Kumar. Petitioner Nos. 1 and 2 are ladies and petitioner Nos. 3 and 4 are brother and father of the

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender before the court below within a period of six weeks from the receipt of this order, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, East Champaran, Motihari, in connection with Rajepur P.S.Case No. 103 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition is that the petitioners have to co-operate in the investigation.
