JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 17-12-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Ahiyapur P.S. Case No. 23 of 2020 registered for the offence punishable under Sections 399 and 402 of the Indian Penal Code, Sections 25(1-b)a, 26 and 35 of the Arms Act and Section 20 and 22 of the N.D.P.S. Act.

It is the prosecution's case that based on a secret information that some criminals had assembled, the police had conducted a raid, leading to arrest of four persons, including this petitioner. On search from the possession of the petitioner, one country made pistol with three live cartridges was recovered and 500 gm of Charas was recovered. From the possession of

Patna High Court CR. MISC. No.33177 of 2020(2) dt.17-12-2020 2/2 another co-accused also country made pistol and 500 gm Charas was recovered. From rest of the two persons apprehended, illegal firearms were recovered. Considering the fact that a total of 1 kg of Charas was recovered from the petitioner and another co-accused, at one place, I am not inclined to grant the petitioner, privilege of regular bail.

This application is accordingly rejected.
