====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 14-05-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 14.06.2018 in a case for the offence registered under Sections 304(B) and 120(B)/34 of the IPC.

The prosecution story, in brief, is that the informant Suryadeo Mahto had solemnized marriage of his daughter Sandhaya Devi with Dilip Kumar in the year 2015 and his daughter gave birth of one child who is two years old. Thereafter, accused persons subjected to torture her physically and mentally for demand of rupees one lac, motorcycle and T.V. in dowry and lastly on 01.06.2018, killed her by hanging her to a ceiling fan.

Patna High Court CR. MISC. No.31912 of 2019(2) dt.14-05-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is the Bhaisur (brother-in-law) of the deceased. He is separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned IIIrd Additional Sessions Judge, Rohtas at Sasaram, in connection with Sessions Trial No. 471 of 2018, arising out of Dehri (T) P.S. Case No. 515 of 2018.
