Mr. Singh, learned Senior Advocate seeks permission to withdraw this application with respect to petitioner No. 1 as he has been arrested.

Patna High Court CR. MISC. No.32473 of 2020(2) dt.12-02-2021 2/3 The application with respect to petitioner No. 1/Deepak Kumar Singh @ Deepak Kumar is dismissed as having become infructuous.

Petitioner Nos. 2 and 3 seek bail in anticipation of their arrest in connection with Raghunathpur P.S. Case No. 31 of 2020, dated 16.02.2020, instituted for the offences under Sections 307 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The petitioners are alleged to have opened fire which led to injuries on the victim. However, all the injuries though are by gunshot but those have been opined to be simple in nature.

It has been submitted on behalf of the petitioners that there is a counter version of the occurrence as well and one person has died from their side, which fact has not been stated in the subject F.I.R.

Regard being had to the facts afore-stated, petitioner Nos. 2 and 3, viz., Upendra Kumar Singh @ Upendra Kumar and Abhishek Kumar Singh @ Abhishek

Patna High Court CR. MISC. No.32473 of 2020(2) dt.12-02-2021 3/3 Kumar, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VIII, Siwan in connection with Raghunathpur P.S. Case No. 31 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
