In this case, the petitioner is seeking bail in connection with Barhara P.S. Case No. 280 of 2019 registered for offences under sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case, in short, is that on 16.8.2019 at 10 PM when the Informant was taking dinner with his younger brother, a call came on his mobile after which he left on his motorcycle. Later on at about 10.25 PM, a call was received on his uncle's mobile informing him that his brother was being shot and was lying injured in front of the Kashiram's house. The Informant reached there and took him to Sadar Hospital, Ara where he was declared brought dead.

No.36371 of 2020(4) dt.09-04-2021 2/2 From the case diary, it appears that the deceased was to pay Rs. 2,000/- to Daroga Ram and he was threatened that if he will not make payment to him, he will be finished. On the fateful day, he was in drunken state and he asked Rahul Kumar Singh (deceased) as to why he is not returning the money. On that account, both of them entered into the hot discussion whereupon he took out pistol and killed the victim. Looking to the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected.
