JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 21-06-2022 Heard the learned counsel for the petitioners as well as the learned counsel for opposite party no. 2. The petitioners apprehend their arrest in connection with Complaint Case No. 2865 of 2015 registered for offence punishable under sections 406, 498A, 323 of the Indian Penal Code.
Anita Devi, the complainant made allegation against petitioner no. 1, Sujeet Kumar, her husband that after her marriage with petitioner no. 1 in the year 2008, her husband and in-laws demanded a motor cycle, Rs.1,00,000/- cash, a television and they tortured her for non-fulfillment of the demand. The learned counsel for opposite party no. 2 submits that

The learned counsel for the petitioner has submitted that opposite party no. 2 has solemnized her second marriage and Annexure-2 shows that her second husband, Vrigunath Thakur had purchased a piece of land on 16.11.2020 in her favour. He has submitted further that after solemnization of her second marriage, the complainant is avoiding to appear before the Court. Considering the above-mentioned facts and circumstances, the petitioners above-named, in the event of their arrest or surrender, within four weeks from today, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Siwan in connection with Complaint Case No. 2865 of 2015, subject to condition as laid down under section 438(2) Cr. P.C.
