2. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 457, 380 of the Indian Penal Code and later on Section 411 of Indian Penal Code was added.

3. Learned counsel for the petitioner submits petitioner is not named in the FIR. The name of the petitioner has transpired during investigation on the basis of confessional statement of the co-accused Md. Sakir Ansari. Except confessional statement of the co-accused, there is no material evidence against him. Petitioner claims clean antecedent.

4. Learned counsel for the State opposes the anticipatory bail petition of the petitioner.

5. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.35045 of 2023(2) dt.27-07-2023 2/2 of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Judge-IX-cum A.C.J.M. IX Patna in connection with Shastri Nagar P.S. Case No. 738 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
