1. Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 341, 504, 506, 307 and 302 of the Indian Penal Code.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman and has been falsely implicated in the instant case by the informant who alleges that on 17.01.2024 while his father was having meal when accused, Ganita Devi, came and started abusing, on protest, the petitioner along with other co-accused came and assaulted his father, further Vijay Sahni assaulted his father by an iron rod causing injury on head, thereafter, Chandeshwar Sahni also assaulted by wooden stick and when informant and his sister intervened, they were assaulted by Ganita Devi, Ranjan and Ravi Kumar.
4. The learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.37396 of 2024(2) dt.27-06-2024 2/2 from perusal of the allegation as alleged in the F.I.R., it would manifest that there is no specific allegation of assault against the petitioner and the entire family members have been implicated.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner and fact that petitioner is a woman and no specific allegation is alleged against her, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Baligaon P.S. Case No. 07 of 2024 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. Accordingly, the present anticipatory bail application stands allowed.
