2. The petitioner apprehends his arrest in connection with Buxar (M) P.S. Case No.72 of 2026 for allegedly having committed offences under Sections 126(2), 117(2), 109, 351(2), 351(3), 352, 303(2) and 3(5) of the B.N.S.

As per the First Information Report, which has been lodged on the basis of the written report submitted by the informant, to the effect that on the date of occurrence while he was returning after dropping his friend Mayank Mishra at his home, all the accused persons, including the petitioner herein, who were present from before, armed with iron rod, hockey stick and pistol stopped his vehicle and started assaulting and using filthy language against him. When the informant objected to their behaviour, co-accused, Sandip Yadav with an intention to kill him
2/4 assaulted with an iron rod and butt of the pistol on his head, due to which he sustained injuries and fell down on the ground. Thereafter all the accused persons, including the petitioner, with an intention to kill him started assaulting him with iron rod, hockey stick and legs and fists on the entire body, due to which he sustained fracture in three fingers in his right hand as well as on the left leg. When people from nearby vicinity came there, the accused persons fled away, presuming the informant to be dead and while fleeing away they also took away his mobile phone, key of his bike and Rs.21,200/- in cash, apart from gold chain.
4. The learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. He submits that specific allegation of assault on the head of the informant has been levelled against co-accused, Sandip Yadav and against the petitioner and other co-accused persons only general and omnibus allegation of assault has been levelled in the First Information Report. He further submits that for the same occurrence, the grand mother of co-accused, Sandip Yadav also lodged a First Information Report bearing Buxar Mufassil P.S. Case No.75 of 2026 under different sections of the B.N.S. against the informant and others. He further submits that the informant is a hardcore criminal and has got four criminal antecedents. He further submits that the entire allegation levelled in the First
3/4 Information Report are totally false and concocted and from the injury report, it would transpire that although the informant has received grievous injuries, but the same have been found to be on hand, since fracture has been found on the fingers of the informant. It is also submitted that the petitioner is an accused in one another case bearing Buxar Town P.S. Case No.546 of 2024, however the petitioner is on bail in the said case.

Per contra, the learned A.P.P. for the State opposes the prayer for grant of anticipatory bail to the petitioner and submits that the petitioner and others brutally assaulted the informant, due to which he sustained injuries on his head as well as multiple injuries have been found by the treating doctor.

Having considered the rival submissions and after going through the records, it appears that specific allegation of assault on the head of the informant has been levelled against coaccused, Sandip Yadav and so far the petitioner and other coaccused persons are concerned, general and omnibus allegation of assault with iron rod, hockey stick and fists and legs has been alleged against them. From the injury report, which has been annexed with the case diary, it would transpire that the treating doctor has found multiple fracture in the fingers of the informant and the same have been found to be grievous in nature, caused by hard and blunt substance, however the same are not on the vital
4/4 part of the body.

Taking into consideration the facts aforesaid, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Buxar in connection with Buxar (M) P.S. Case No.72 of 2026, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take steps for cancellation of his bail bond. However, the acceptance of bail bond in terms of the abovementioned order shall not be delayed for purpose of or in the name of verification.
