Petitioner seeks bail in a case registered for the offences punishable under sections 22 and 23 of the N.D.P.S. Act. The police searched the house of the petitioner and recovered 18 Kg. of Ganja.

It is submitted that the petitioner has got no criminal antecedent. During the course of investigation witnesses have stated that brother of the petitioner has falsely implicated the petitioner on account of enmity.

It appears that 18 Kg. of Ganja was recovered from the house of the petitioner.

Considering the facts aforesaid, I am not inclined

Patna High Court Cr.Misc. No.22539 of 2015 (3) dt.15-09-2015 to enlarge the petitioner on bail in connection with Lakhisarai (Kabaiya) P.S. Case No. 720 of 2014 pending in the court of the learned Sessions Judge-cum-Special Judge under NDPS Act, Lakhisarai. His prayer for bail is, accordingly, rejected. The petitioner may renew his prayer for bail after remaining one year in custody.
