2. The petitioner is apprehending his arrest in connection with Complaint Case No. 925 of 2023 for the offence under Sections 498A, 307 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.

3. Petitioner is husband of O.P. no. 2 and this case relates to matrimonial dispute between the parties.

4. Today, memorandum of settlement has been filed by the learned counsel for both the parties, in which entire dispute has been settled amicably and the terms and conditions has been mentioned therein.

5. Keeping in view the aforesaid facts and considering the terms and conditions as mentioned in their Memorandum of settlement, this Court is inclined to enlarge the petitioner on Provisional bail with conditions as mentioned in memorandum of settlement.

7. Let the petitioner be released on Provisional bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned S.D.J.M. Vaishali at Hajipur in connection with Complaint Case No. 925 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

8. Trial Court will confirm the provisional bail granted to the petitioner after verifying the compliance of all the terms and conditions as mentioned in Memorandum of settlment.

9. Accordingly, the instant application stands disposed off.
