Learned counsel for the petitioner is permitted to correct the police station case number of criminal antecedent in para 3 of the bail petition.
Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act. A live cartridge and cash of Rs.3,43,000/- was recovered from possession of the petitioner and a firearm along with cartridge was recovered from possession of co-accused Jai Ram Kumar, who was also along with the petitioner. The cash amount was part of Rs.5.00,000/- allegedly paid by the informant as ransom on demand by the accused persons. Submission is that cash or cartridge was not recovered
Patna High Court CR. MISC. No.31959 of 2019(2) dt.14-05-2019 2/2 from possession of the petitioner. Since, the petitioner was along with Jai Ram Kumar, he has been falsely dragged in this case. Petitioner is in custody since 19.12.2018.
Considering the facts aforesaid, let the petitioner, above named, be released on bail after framing of the charges on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sasaram (Darigaon) Police Station Case No. 1523 of 2018, with the following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned court-below having immovable property.
(b) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. (Birendra Kumar, J) Rajan/Banti U T
