2. This application for anticipatory bail arises out of Manjhaul P.S. Case No. 21 of 2026 for the offences punishable under Sections 126(2), 115(2), 351(2), 303(2), 109(1) and 3(5) of the B.N.S.
3. As per the allegation, on 13.02.2026 at about 6 pm, petitioner along with the other co-accused persons unlawfully trespassed into the house of one Gudiya Devi and started assaulting her son Ayush Kumar and Anil Jha, her Devar, with the butt of a pistol, iron rods and lathis with the intent to kill them and inflicting severe head injuries and injuries over the whole body. They also assaulted a minor boy, Sidharth Kumar,
Patna High Court CR. MISC. No.33906 of 2026(3) dt.24-07-2026 2/3 causing head injuries and also threatened to kill him. It has further been alleged that the accused persons also snatched a mobile phone and Rs. 5000/- in cash.
4. Learned counsel for the petitioner has submitted that petitioner is innocent and has falsely been implicated in this case as a result of enmity between the parties. It has further been submitted that the present case is nothing, but a counter-blast to the case lodged by the petitioner's side. It has further been submitted that there is general and omnibus allegation against the petitioner. It has lastly been submitted that the petitioner has been made accused in one another case, but he is on bail in that case.
5. Learned counsel for the State as well as learned counsel for the informant has vehemently opposed the prayer of anticipatory bail of the petitioner.
6. Learned counsel for the informant has submitted that in similar circumstances, prayer for anticipatory bail of coaccused Prince Kumar and Chhotu Kumar has already been rejected by a co-ordinate Bench of this Court by order dated 17.06.2026 in Cr. Misc. No. 31222 of 2026.
7. Heard the parties and perused the record. Considering the fact that similar prayer for anticipatory bail of
Patna High Court CR. MISC. No.33906 of 2026(3) dt.24-07-2026 3/3 co-accused persons has been rejected by a co-ordinate Bench of this Court, the prayer for anticipatory bail of the petitioner is hereby rejected.
