The petitioner seeks bail in a case instituted for the offence under Sections 406,420,409 and 120B/34 of the Indian Penal Code.
The Circle Officer, Jokihat forwarded a copy of the order dated 30.10.2006 to the Officer-in-charge of Jokihat for lodging FIR against the petitioner and other FIR named accused persons alleging therein that the petitioner along with other accused persons obtained Basgit Parcha of R.S. Khata No. 12, R.S.Plot No. 1557, area 19 decimals illegally and also obtained rent receipts. On the basis of the same the petitioner along with other co-accused persons possesses illegally more
Patna High Court Cr.Misc. No.24974 of 2015 (2) dt.20-07-2015 2/2 than 12 acres of land.
On behalf of the petitioner it has been submitted that the petitioner is in custody since 24.3.2015 and the charge sheet has been submitted in the case. It has further been submitted that on the complaint of one Rahmatullah, the present prosecution has been launched. It has further been submitted that the petitioner is on inimical terms with the said complainant. In fact, the land in question had been purchased by the father of the petitioner.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M. Araria in connection with Jokihat P.S. Case No. 63 of 2007.
