JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-07-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. No doubt, the petitioner was made accused in the first information report but after investigation, police found the accusation untrue in respect of the petitioner and accordingly, the petitioner was not sent up for trial. Furthermore, it would appear that some accused were put on trial and in that course, a petition u/s 319 of the Cr.P.C. was filed which was allowed by the trial court and accordingly, the petitioner was summoned u/S 319 of the Cr. P.C.

Considering the facts and circumstances of the case as well as submission of the parties, let the petitioner

Patna High Court Cr.Misc. No.22878 of 2015 (2) dt.07-07-2015 2/2 named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Gogri P.S. Case No. 172 of 2007 corresponding to Sessions Trial No. 186 of 2011 to the satisfaction of 3rd Ad hoc Additional Sessions Judge, Khagaria.
