The petitioners are languishing in custody since 11.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 324, 307, 379, 436 and 302 of the Indian Penal Code.

It is alleged by the informant that his own brother Ram Pravesh Rai with his family members came to the informant began to assault the father of the informant. The petitioners are wife and daughter-in-law of Ram Pravesh Rai. When the informant, his wife and daughter went to rescue they were also assaulted. Subsequently, the father of the informant succumbed to the injuries.

No.13218 of 2015 (03) dt.08-05-2015 2/2 It is submitted by learned counsel for the petitioners that due to the share dispute in the property the occurrence took place and there is counter version of the occurrence also. The accusation of assault to the father of the informant is omnibus and general against these two petitioners. Petitioner no. 2 Anita Devi is in custody with a child aged about three years.

Considering the fact that the accusation of assault to the father of the informant is omnibus and general against the petitioners, the investigation has already concluded and the petitioners being lady, let them be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Derani P.S. Case No. 71 of 2014.
