The petitioner is languishing in custody since 24.09.2013 in a case registered for the offences punishable under sections 395 of the Indian Penal Code.

Accusation is of committing dacoity at the brick kiln of the informant. The name of the petitioner sprang up during investigation when he was identified by the informant. It is submitted by learned counsel for the petitioner that the petitioner has been implicated in this case on the basis of confession of co-accused Jawahar Pasi, who has been granted bail vide Criminal Miscellaneous No.50046 of 2013 and there is no recovery from the petitioner.

No.22311 of 2015 (2) dt.07-07-2015 2/2 Considering the aforesaid fact, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge, IV, Kaimur, Bhabua in connection with Ramgarh (Nuaon) P.S. Case No.107 of 2013.

Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of the petitioner, if he defaults for two consecutive occasions or gets involved in some serious nature of offence. (Dinesh Kumar Singh, J) Ashwini/- U T
