JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners are named in the first information report and it would appear from perusal of the first information report that a quarrel took place between the parties on a petty issue and in that quarrel, petitioners and other accused are said to have assaulted the deceased with lathi and danda and it is specifically stated that petitioner no. 1 gave one stone blow which hit on the temple of the deceased. The impugned order shows that no external injury was found at the time of post mortem examination of the deceased but some ribs were found broken.
Submission on behalf of the petitioner is that the
Patna High Court Cr.Misc. No.15718 of 2016 (2) dt.19-04-2016 2/2 deceased was unloading the bags of salt but, unfortunately, one bag fell on him and deceased sustained injuries and, subsequently, deceased died but informant lodged this false case only on the ground of suspicion. Moreover, the investigation against the petitioners has already been completed and their further detention in jail does not require.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,1st class, Madhubani in connection with Basopatti P.S.Case No. 144 of 2015.
