The petitioner is languishing in custody since 03.02.2015 in a case registered for the offences punishable under sections 260 and 420 of the Indian Penal Code. It is alleged against the petitioner that he used genuine government stamp of Rs.20/- on affidavit knowing it to be counterfeit.

It is submitted by learned counsel for the petitioner that petitioner did not affix the alleged stamp rather he only identified Akbar Ansari, Sayara Khatoon and Habib Ansari before the notary public. It is further submitted that petitioner has
