Petitioner is apprehending his arrest in connection with Panapur P.S.Case No.169/18 , registered for offences punishable under Sections 341, 323, 324, 307, 379, 504, 506, 34 of the Indian Penal Code.

Allegation against the petitioner is of assault by Farsa on the informant.

Submission of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case due to enmity and earlier also a case had been lodged by the father of the informant against the petitioner, injuries are simple in nature.

Heard learned A.P.P. , who has submitted that the injury

Patna High Court CR. MISC. No.32266 of 2019(3) dt.26-07-2019 2/2 report is not visible in the case diary, whereas the impugned order shows that there is incised wound on the occipital area of skull with bleeding caused by sharp cutting substance. Having heard both sides and in view of submission of the learned counsel for the petitioner that the injury is simple in nature, this application is disposed of with direction to the learned court below to verify the injury and if submission is found true and the injury is simple, he shall release the petitioner on bail to his own satisfaction . Petitioner has to surrender and pray for regular bail.

With the above direction, this application is disposed of.
