Petitioner is in jail custody in a case of dacoity but admittedly, neither petitioner is named in the first information report nor anything was recovered from his conscious possession and except confessional statement of co- accused, there appears to be nothing against the petitioner.

Moreover, having more or less similar allegation several co-accused persons have already been granted privilege of bail. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara in Jagdishpur P.S.
