Mr.Rabindra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 20-08-2022 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are in custody since 31.03.2022 in connection with Dehri(M) P.S. Case No. 146/2021 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

There is recovery of 2254 litres of country made liquor from the tractor. F.I.R. was registered against six accused persons including these petitioners.

Considering the fact that the petitioner no. 1 has clean antecedent whereas petitioner No. 2 is accused in two cases and they in custody since 31.03.2022 they shall be released on bail

Patna High Court CR. MISC. No.35381 of 2022(2) dt.20-08-2022 2/2 after framing of charge or on completion of one year in custody whichever is later, on furnishing bail bonds of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge, XIII cum Special Judge, Excise II, Rohtas at Sasaram in connection with Dehri (M) P.S. Case No. 146 of 2021. The petitioners will visit the concerned Police Station on the first Sunday of each month. Any default in appearance at the station would result in cancellation of bail bond of the petitioners.
