The petitioner apprehends his arrest for the offences alleged under Sections 409 and 420 of the Indian Penal Code, registered in connection with Barahara P.S.Case No.670 of 2022.

As per the allegation, certain irregularities were found in the work of construction of road etc. under the Saat Nishchay Yojna of the Government.

The learned counsel for the petitioner has submitted that the Ward Secretary has been granted bail. He has submitted further that the Junior Engineer, who was also an accused in this

Patna High Court CR. MISC. No.35146 of 2023(2) dt.26-07-2023 2/2 case, has been granted anticipatory bail by a coordinate Bench of this Court in Cr.Misc. No. 24049 of 2023. The case of the petitioner is on better footing since he is a Technical Assistant and is working under the Junior Engineer, who has been granted anticipatory bail, as mentioned above. The petitioner is a person of clean antecedent.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Barahara P.S.Case No.670 of 2022. subject to the conditions as laid down under Section 438(2) Cr. P.C.
