2. The petitioner apprehends his arrest in connection with Rafiganj P.S. Case No.523 of 2025, for allegedly having committed offences under Sections 126(2), 127, 115(2), 85, 74, 351(3) and 3(5) of the B.N.S., 2023.

As per the prosecution story, which has been lodged on the basis of the written report submitted by the informant, to the effect that she was at her home with two little daughters, aged about five years and eight years. On the date of occurrence, the elder brother of Pawan Singh @ Pawan Sharma (petitioner herein), started assaulting the informant. When the cousin sister of the informant came there, the elder brother of the petitioner, namely, Jai Kishore Singh, Balmiki Singh, the petitioner and Poonam Devi
Patna High Court CR. MISC. No.34049 of 2026(2) dt.18-05-2026 2/3 also started assaulting the informant and her cousin, due to which she suffered injuries on her body. All the accused persons kept confined the informant in a room and upon information, the police party rescued the informant from the room.

The learned counsel for the petitioner submits that the entire allegation of assault is against the elder brother of the petitioner, namely, Jai Kishore Singh and the allegations against the petitioner and others are general and omnibus. The present case has been filed due to matrimonial discord and minor scuffle which took place in the family. Other co-accused persons have been granted the privilege of anticipatory bail by the learned District Court itself. He further submits that from perusal of the injury report, which has been annexed as Annexure-2 to the present bail petition, it would transpire that the injury found on the body of the informant was simple in nature. It is further submitted that the petitioner is ready to reconcile the matter with her wife and he has got a clean antecedent.
5. The learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.
6. Having heard the learned counsel for the parties and after going through the records, it appears that general and omnibus allegation has been levelled against the petitioner and others. Specific allegation of assault is against the elder brother of
Patna High Court CR. MISC. No.34049 of 2026(2) dt.18-05-2026 3/3 the petitioner, namely, Jai Kishore Singh and nothing specific has been alleged against the petitioner. The petitioner has got a clean antecedent.

Taking into consideration the facts aforesaid, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Aurangabad in connection with Rafiganj P.S. Case No.523 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S. with a further condition that:- The learned court concerned shall verify the criminal antecedent of the petitioner and in case at any stage it is found that the petitioner has concealed his criminal antecedent, the court concerned shall take steps for cancellation of bail bond of the petitioner. However, the acceptance of bail bond in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
