JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 304B/34 of the Indian Penal Code.

Petitioner happens to be mother-in-law of the deceased and the impugned order goes to show that the husband of the deceased has already been granted privilege of bail. Moreover, it would appear from paragraph-2 of the petition that petitioner came before this Court for grant of anticipatory bail and her anticipatory bail was disposed of by a Co-ordinate Bench of this Court with a direction to surrender before the court below within a period of six weeks and make prayer for regular bail which shall be considered by the concerned court on its own merit without being prejudiced by the order. It appears that in compliance of the

Patna High Court Cr.Misc. No.16577 of 2016 (2) dt.26-04-2016 2/2 aforesaid direction, petitioner surrendered before the court below on 27.2.2016 and since then she is languishing in jail custody. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Kishanganj in connection with Bahadurganj P.S. Case No.24 of 2011.
