The petitioner, who is the sister-in-law of the deceased, seeks bail in anticipation of her arrest in connection with Mali P.S. Case No. 26 of 2020 dated 31.03.2020 instituted for the offences under Sections 304(B) and 34 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that though the petitioner has been named in the FIR but the accusation against her is general and omnibus. The husband as well as the father-in-law of the deceased are in custody.

It has further been submitted that though charge sheet in this case was submitted under Section

Patna High Court CR. MISC. No.32592 of 2020(2) dt.19-02-2021 2/2 304B but cognizance has been taken under Section 306 of the IPC. The petitioner along with her husband were staying separately from the deceased and her husband for quite sometime.

Considering the aforenoted facts, the petitioner is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Mali P.S. Case No. 26 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
