JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Although victim stated in her statement recorded under Section 164 of the Code of Criminal Procedure that she was forcibly taken away by the petitioner and, after that, she was confined in the house of the petitioner but the victim admitted that she was dropped by petitioner himself at Navgachia and she was never sexually assaulted by the petitioner. The learned Magistrate at the time of recording the statement of victim under Section 164 of the Code of Criminal Procedure found her age about 19 years whereas victim disclosed her age as 18 years. Petitioner is in jail custody since 10.08.2015 and the investigation against him has already been completed.
