The petitioner apprehends arrest in a case registered for the offence punishable under sections 399/402/414 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent.
Considering the aforesaid facts of the case, prayer for
Patna High Court CR. MISC. No.35936 of 2022(2) dt.01-11-2022 2/2 bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Majhaulia Police Station Case No. 129 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
