JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 35 of the Arms Act. Petitioner and one other accused were caught while they were going on a motorcycle and one country made loaded katta and one live cartridge were recovered from conscious possession of the petitioner for which petitioner is in jail custody since 08.12.2015. Moreover, petitioner does not have any criminal antecedent and the investigation against the petitioner has already been completed.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.16672 of 2016 (2) dt.27-04-2016 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A. Pandey, Judicial Magistrate 1st Class, Siwan in connection with Darauli P.S. Case No. 194 of 2015.
