JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections 457 and 380 of the Indian Penal Code. Petitioner is in jail custody since 25.12.2015 on the accusation that he was caught by the villagers when he was entered into the house of informant's son for committing theft and it is alleged that some instruments were recovered from possession of the petitioner.
Contention on behalf of the petitioner is that the seizure list does not bear the signature of the petitioner and as a matter of fact, nothing was recovered from conscious possession of the petitioner. It is further submitted that petitioner had gone to
Patna High Court Cr.Misc. No.17953 of 2016 (2) dt.29-04-2016 2/2 his relatives but unfortunately, he was caught by the villagers on mere suspicion.
Considering the aforesaid submissions as well as period of detention of the petitioner in jail custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Jhanjharpur, District Madhubani in connection with Bhairav Asthan P.S. Case No.111 of 2015.
