JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-04-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-323, 302, 120(B)/34 of the Indian Penal Code. Petitioner is named in the first information report but according to prosecution case itself, an altercation took place between the deceased and co-accused, Sanjay Yadav and after the aforesaid altercation, the deceased took liquor in the company of petitioner and some others and subsequently, next morning the dead body of the deceased was found in a maize field. Admittedly, none has seen actual killing of the deceased and the altercation had taken place between the deceased and co-accused, Sanjay Yadav.

No.16526 of 2016 (2) dt.26-04-2016 2/2 Learned counsel for the petitioner submits that except suspicion, there is nothing against the petitioner and moreover, the investigation of the case has already been completed. Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Murliganj P.S. Case No. 65 of 2015 to the satisfaction of Chief Judicial Magistrate, Madhepura.
