The petitioner apprehends his arrest in Barh P.S. Case No.111 of 2019 registered under Section 30(a), 38 and 41 of Bihar Prohibition and Excise Act.

The police on secret inputs raided a place on the information that one person is illegally selling liquor but when the police reached there, one person fled away. The informant seized about 9 liters of country made liquor and motorcycle bearing registration No.BR-01CN-1933 and cash of Rs.2,035/-. The learned counsel for the petitioner submits that petitioner is not owner of the motorcycle bearing registration No.BR-01CN-1933. Petitioner has got no manner of concern with the seized motorcycle, cash and liquor. The people assembled there are said to have disclosed the name of the

Taking into consideration the facts that petitioner is not the owner of the motorcycle and save and except the fact that name of the petitioner figured in the case by the disclosure of people assembled at the place of occurrence and petitioner has no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna in connection with Special Case No.2396 of 2019, arising out of Barh P.S.
